# Terms and Conditions

Welcome to Superbee Australia. These Terms and Conditions ("Terms")
govern your access to and use of www.superbee-australia.com.au (the
"Website") and any purchase you make through it. By browsing the
Website, creating an account, or placing an order, you agree to be bound by
these Terms. If you do not agree, please do not use the Website.

## 1. Who we are
The Website is operated by **Farination Pty Ltd** trading as **Superbee
Australia** (ABN 55 689 389 517), of 8 Godwin Street, Mernda VIC 3754,
Australia ("Superbee Australia", "we", "us",
"our").

## 2. Using our Website
You must be at least 18 years old, or have the involvement of a parent or
guardian, to place an order with us. By using the Website you agree to:

- provide accurate, current, and complete information when creating an account
or placing an order;

- keep your account login details confidential and notify us of any
unauthorised use;

- use the Website only for lawful purposes and not in any way that could
damage, disable, or impair it, or interfere with anyone else's use of it.

We may suspend or terminate your access to the Website or cancel an account at
our discretion, including where we reasonably believe these Terms have been
breached.

## 3. Products and pricing
We make reasonable efforts to display our products, descriptions, and pricing
accurately. However:

- product colours, packaging, and appearance may vary slightly from images
shown on the Website, including due to display settings and natural variation
in materials such as beeswax and fabric;

- all prices are listed in Australian dollars (AUD) and are inclusive of GST
where applicable, unless stated otherwise;

- we reserve the right to change prices, descriptions, and product availability
at any time without notice, and to correct any pricing or typographical errors,
including after an order has been placed. If an error affects an order you've
placed, we will contact you before proceeding and you may cancel the order for
a full refund;

- we do not guarantee that any product will be available at all times.

## 4. Orders and acceptance
Placing an order on the Website is an offer by you to purchase the selected
products. A contract of sale is only formed when we send you an order
confirmation email. We reserve the right to refuse or cancel any order,
including where:

- a product is out of stock or discontinued;
- there is an error in the price or product description;
- we suspect fraud, unauthorised, or illegal activity; or
- we are unable to verify or obtain authorisation for your payment.

If we cancel an order after payment has been taken, we will provide a full
refund to your original payment method.

## 5. Payment
We accept payment via the methods displayed at checkout (which may include
credit/debit card, and other options processed through Shopify Payments and its
payment partners). By providing payment details, you confirm you are authorised
to use that payment method. All payments are processed securely by our
third-party payment providers; we do not store your full card details on our
systems.

## 6. Shipping and delivery

We ship within Australia and internationally.

- Estimated delivery times shown on the Website or at checkout are estimates
only and are not guaranteed. Delays can occur due to carrier delays, high
demand, weather, customs processing, or other circumstances outside our
control.

- Shipping costs are calculated at checkout based on your delivery address and
order size, unless a promotion states otherwise.

- Risk in the products (but not title, which passes on full payment) passes to
you on delivery to the address you provide.

- **International orders:** you are responsible for any customs duties, import
taxes, GST, or other charges levied by the destination country. These are not
included in our prices or shipping fees and are your responsibility to pay. We
are not responsible for delays caused by customs clearance processes.

- Please ensure your delivery address and contact details are accurate — we
are not responsible for orders delayed, lost, or misdelivered due to incorrect
information provided at checkout.

## 7. Returns, refunds, and your consumer guarantees
**Our goods come with guarantees that cannot be excluded under the Australian
Consumer Law.** You are entitled to a replacement or refund for a major failure
and compensation for any other reasonably foreseeable loss or damage. You are
also entitled to have the goods repaired or replaced if the goods fail to be of
acceptable quality and the failure does not amount to a major failure.

Outside of these consumer guarantee rights, we do not offer change-of-mind
returns or refunds — please choose carefully and check product descriptions,
sizes, and materials before ordering.

If you believe a product is faulty, not fit for purpose, or significantly
different from its description, contact us at

issue, and photos where relevant. We will assess your claim and, where it's
valid under the Australian Consumer Law, arrange a repair, replacement, or
refund (at our election, as permitted by law), or a refund of reasonable return
shipping costs where applicable.

Nothing in these Terms restricts, limits, or modifies your rights under the
Australian Consumer Law (Schedule 2 of the *Competition and Consumer Act 2010*
(Cth)) or any other rights that cannot lawfully be excluded.

## 8. Intellectual property
All content on the Website ” including text, graphics, logos, images, product
photography, and the Superbee Australia brand ” is owned by or licensed to
Farination Pty Ltd and is protected by copyright, trade mark, and other
intellectual property laws. You may not reproduce, distribute, modify, or
otherwise use this content for commercial purposes without our prior written
consent.

## 9. Third-party links
The Website may contain links to third-party websites or services we do not
control. We are not responsible for the content, accuracy, or practices of any
linked third-party site, and including a link does not imply our
endorsement.

## 10. Limitation of liability
To the maximum extent permitted by law, and subject to your rights under the
Australian Consumer Law that cannot be excluded:

- our liability for any loss or damage arising from your use of the Website or
purchase of products is limited to, at our option, replacing the goods,
supplying equivalent goods, repairing the goods, or refunding the price
paid;

- we are not liable for any indirect, incidental, special, or consequential
loss or damage, including loss of profits or data, arising from your use of the
Website or our products;

- nothing in these Terms excludes, restricts, or modifies any consumer
guarantee, right, or remedy under the Australian Consumer Law where it would be
unlawful to do so.

## 11. Indemnity

You agree to indemnify and hold Farination Pty Ltd, its directors, employees,
and agents harmless from any claim, loss, or damage (including reasonable legal
costs) arising from your breach of these Terms or misuse of the Website.

We collect and handle personal information in accordance with our Privacy
Policy, which is currently being finalised and will be published on the Website
separately at www.superbee-australia.com.au. Once published, it will form part
of these Terms by reference.

## 13. Changes to these Terms
We may update these Terms from time to time to reflect changes in our business,
legal requirements, or the Website. The updated version will be posted on this
page with a revised "Last updated" date and takes effect from the
date of posting. Your continued use of the Website after changes are posted
constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Victoria, Australia. You submit to the
non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of
Australia in relation to any dispute arising from these Terms or your use of
